At some point in their career, your staff may have been taught sales practices by their peers rather than by formal training. Unfortunately, some dealership practices they may have learned are not necessarily the most legal or ethical way to do things. Without proper knowledge, it's very easy to inadvertently step over the line legally or ethically when trying to make a deal. After all, if no one taught you or your people the proper rules, how can you be expected to follow them?
Many of your salespeople haven't a clue about the laws and regulations that affect our industry. Even if you're well trained in compliance, there's a good possibility that uninformed salespeople may make compliance missteps without your knowledge. After all, salespeople typically spend hours talking with their customers and it's unlikely that you're going to be privy to all of those conversations. Acts of noncompliance often begin when a misinformed employee promises a buyer something that the dealership can't deliver. Unfortunately, attorneys and regulators don't differentiate between job descriptions when pursuing a claim against a dealership.
